Terms of Service

Please read these Terms carefully. By accessing or using OmegleChat, you agree to be bound by them.

1) Acceptance of Terms

These Terms of Service (the “Terms”) govern your access to and use of OmegleChat (the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2) About the Service

OmegleChat connects you with other users for real-time conversations via text and/or video. Video sessions may use peer-to-peer technology, which means your approximate network information (such as IP address) can be exposed to the other participant as a technical necessity. You may be able to save conversations as chatlogs. Features may change from time to time.

3) Eligibility

  • You must be at least 18 years old to use OmegleChat. Do not use the Service if you are under 18.
  • You may use the Service only in compliance with applicable laws, rules, and regulations where you live.

4) Acceptable Use

To keep the Service safe and respectful, you agree to:

  • Follow our Community Guidelines.
  • Not share, request, or engage in illegal content or activity.
  • Not engage in nudity, sexual content, or sexual conduct on the Service.
  • Not harass, threaten, or discriminate against others, or incite violence or hatred.
  • Not share personal information that could compromise your safety.
  • Not spam, advertise, run scams, or distribute malware/phishing links.
  • Not scrape, reverse-engineer, or interfere with the Service’s operation.

5) User Content and License

You are responsible for the content you share. You retain ownership of your content, but grant OmegleChat a non-exclusive, worldwide, royalty-free license to host, transmit, process, display, and otherwise use your content as needed to operate, improve, and secure the Service, including moderation, troubleshooting, and storage of saved chatlogs when you choose to save them.

6) Recording and Privacy

  • Do not record, screenshot, or share conversations or video without explicit consent.
  • Other participants may still record using external tools. By using the Service, you understand these risks and agree to act cautiously.

7) Moderation and Enforcement

We may use automated systems and human moderators to detect and respond to violations. We may remove content, restrict features, or suspend/ban users to protect the community. Repeated or severe violations can lead to permanent bans. We are not obligated to monitor all activity but may do so to uphold these Terms and our policies.

8) Service Changes

We may add, change, or remove features, or discontinue the Service at any time. We may also update these Terms. If you continue using the Service after changes take effect, you accept the updated Terms.

9) Intellectual Property

OmegleChat and its logos, designs, and software are owned by us or our licensors and are protected by intellectual property laws. Except for the limited rights granted to you to use the Service, no rights are transferred to you.

10) Third-Party Links and Services

The Service may include links to third-party sites or use third-party tools. We are not responsible for their content, policies, or practices. Use them at your own risk and review their terms and privacy policies.

11) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION, OR THE CONDUCT OF OTHER USERS.

12) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OMEGLECHAT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF $50 OR THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS PRECEDING THE CLAIM.

13) Indemnification

You agree to defend, indemnify, and hold harmless OmegleChat and its affiliates from any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service or your violation of these Terms or applicable law.

14) Termination

You may stop using the Service at any time. We may terminate or suspend your access immediately for any reason, including violations of these Terms or our policies.

15) Governing Law and Venue

These Terms will be governed by applicable laws without regard to conflict-of-laws principles. Venue and jurisdiction for any disputes arising out of or relating to these Terms or the Service will be determined in accordance with applicable law and any mandatory consumer protection rules that apply to you. Nothing in this section limits your rights under the laws of your place of residence when those laws cannot be waived by contract.
